By accessing or using the Website or Services, you (“User,” “you,” or “your”) agree to be bound by this Agreement, our Privacy Policy (available at https://dogtraining.world/privacy/), and any applicable operating rules or domain licenses, all of which are incorporated herein by reference. If you do not agree to these terms, you must immediately cease using the Website and Services.

1. Acceptance of Terms

1.4. Service Modifications. K9-1 may change, suspend, or discontinue any aspect of the Website or Services, including content, features, or availability, at any time without notice.

2. Privacy Policy
K9-1 respects your privacy and allows you to control the treatment of your personal information. Our Privacy Policy, available via the “Privacy Policy” link at the bottom of our web pages, is incorporated into this Agreement and governs the collection, use, and disclosure of your data.

3. User Equipment
You are responsible for obtaining and maintaining all hardware, software, and other equipment necessary to access and use the Website and Services, as well as all related costs.

4. Services
4.1. Description. K9-1 provides access to resources, including video classes, educational materials, private communication forums, and product information (collectively, “Services”). Services, including updates, enhancements, or new features, are subject to this Agreement and the Privacy Policy.

  • Restrict or inhibit others’ use or enjoyment of the Services.
    4.3. Communication Services. Services may include email, forums, chat areas, or other communication facilities (“Communication Services”). You agree to use Communication Services only for appropriate, relevant, and lawful communications and shall not:
  • Post defamatory, obscene, or unlawful content;
  • Infringe intellectual property or privacy rights;

K9-1 does not endorse or control Communication Service content and disclaims liability for any actions resulting from your participation.
    4.4. Coursework Access and Completion Policy.
  • Availability. The Services include educational coursework, such as video classes and related materials (“Courses”). Access to Courses is subject to this Agreement and any applicable subscription or enrollment terms.
  • Inactivity and Access Revocation. K9-1 may revoke Course access for Users inactive for six (6) months, defined as failure to complete a unit of coursework, as tracked by the Website’s system. To maintain access, Users must complete at least one unit within the six-month period.
  • Completion Deadline. Users have two (2) years from the start of a Course or initial enrollment to complete all posted coursework. If a User fails to complete the Course within this period, K9-1 may revoke access without notice. Partial progress or payments do not extend this deadline.
  • Reasonableness. These policies ensure efficient resource management, maintain an active User community, and provide high-quality, updated content.

5. Account Security
If you register for an account, you must provide accurate, complete information and maintain the confidentiality of your username and password. You are responsible for all activities under your account and may not use another’s account. K9-1 is not liable for losses caused by unauthorized use, but you may be liable for losses incurred by K9-1 or others due to such use.

6. Intellectual Property
6.1. K9-1 Content. The Website and Services contain copyrighted material, trademarks, and proprietary information owned by K9-1 or third parties, protected under United States copyright laws. Limited downloading for personal, non-commercial use is permitted, provided copyright or attribution notices are not altered.
6.2. User Submissions. By submitting content (“Submissions”) to the Website or Services, you grant K9-1 a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, distribute, and incorporate such Submissions in any form or media. You warrant that you own or control all rights to your Submissions and are responsible for any infringement or harm caused. For Submissions containing images, you warrant that you have the necessary rights and consents for their use.

8. Third-Party Content and Links
8.1. Third-Party Content. K9-1 acts as a distributor, not a publisher, of content provided by third parties or Users. We do not guarantee the accuracy, completeness, or suitability of such content and disclaim liability for reliance thereon.

Refunds are subject to the limitations in Section 18.5 (Cessation of Business Operations).

12. Disclaimer of Warranties
12.1. As-Is Basis. The Website and Services are provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
12.2. No Guarantee. K9-1 does not warrant that the Website or Services will be uninterrupted, error-free, or secure, or that results will be accurate or reliable.
12.3. User Risk. You assume all risks associated with use, including from viruses, errors, or unauthorized access.

13. Limitation of Liability
13.1. No Liability. K9-1, its affiliates, and their agents or suppliers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Website or Services, including loss of data, profits, or use.

13.3. Force Majeure. Neither party is liable for delays or failures due to events beyond their control (e.g., acts of God, equipment failure). The affected party must notify the other via email within 15 days, and performance will be suspended until the event is resolved.

14. Indemnification
You agree to indemnify, defend, and hold harmless K9-1, its affiliates, and their directors, officers, employees, and agents from any claims, damages, or expenses (including attorneys’ fees) arising from your use of the Website or Services or breach of this Agreement.

  • Identification of the copyrighted work;
  • Identification of the infringing material;
  • Your contact information;
  • A statement of good faith belief that the use is unauthorized; and
  • A statement of accuracy under penalty of perjury.

16. Dispute Resolution
16.1. Arbitration. All disputes arising from this Agreement shall be resolved through binding arbitration in Westchester County, New York, under the Commercial Arbitration Procedures of the American Arbitration Association. The arbitration award is final and may be entered in any court with jurisdiction. The prevailing party is entitled to reasonable attorneys’ fees and costs.
16.2. Governing Law. This Agreement is governed by the laws of New York and the United States, without regard to conflict of law principles.
16.3. Venue. You consent to the exclusive jurisdiction of state or federal courts in Westchester County, New York, for non-arbitrable disputes.

18.2. Entire Agreement. This Agreement, the Privacy Policy, and any operating rules or domain licenses constitute the entire agreement between you and K9-1, superseding all prior agreements.
18.3. Severability and Waiver. If any provision is unenforceable, the remaining provisions remain in force. No waiver of a breach constitutes a waiver of other breaches, and waivers are effective only if in writing and signed.
18.4. Assignment and Change of Control.

  • Assignment by K9-1. K9-1 may assign or transfer this Agreement, including all rights and obligations, to a successor, affiliate, or third party in connection with a merger, acquisition, sale of assets, reorganization, or other change of control, without notice or User consent.
  • User Obligations. Upon assignment, this Agreement, including your rights and obligations (e.g., Course access, payment terms), will remain binding and inure to the benefit of K9-1’s successor or assignee.
  • Non-Assignable by User. You may not assign your rights or obligations without K9-1’s written consent.
  • Reasonableness. This provision ensures Service and Course continuity during business transitions, protecting K9-1’s operational needs and Users’ expectations.
    18.5. Cessation of Business Operations.
  • Termination of Services. If K9-1 ceases operations, dissolves, becomes insolvent, or files for bankruptcy (“Cessation Event”), K9-1 may terminate this Agreement and all Services, including Website and Course access, immediately without liability.
  • Loss of Access and Fees. Upon a Cessation Event, Users will lose access to the Website, Courses, and Services. K9-1 shall not provide refunds for prepaid fees, incomplete Courses, or unfulfilled Services, as such payments may be subject to bankruptcy proceedings.
  • Notification. K9-1 will make reasonable efforts to notify Users of a Cessation Event via email or Website posting, subject to operational constraints.
  • Reasonableness. This provision ensures K9-1 can manage obligations in the unlikely event of closure, aligning expectations with the realities of insolvency or dissolution.
